Role of Chancellor in State Universities
About Book - This work presents a comprehensive study of the power, position and role of Chancellor of state universities after the adoption of the Constitution of India. The office of Chancellor is the legacy of British rule in India and has been the subject of debates and discussions. The position of Governor- Chancellor has been subjected to judicial scrutiny and it has now been established that the twin status are different and distinct from one another. While the former emanates from the Constitution of India, the latter is the offspring of various state universities' Acts passed by respective state governments. The position of Visitor in British Universities has influenced the judiciary to a large extent.
Lately, the educational law has gained much impetus in India so much so that the Bar Council of India and the University Grants Commission have recommended its inclusion in the LL.B. (Hons.) curriculum. The model syllabi, recently circulated by UGC, provides one seperate field of study viz. "Educational Process, Planning and the Law" which includes topics such as constitutional goals, equality of opportunity to education, minorities and their fundamental right to establish and administer institutions, governmental control and dispute settlement mechanism in these institutions of learning. This paper, inter alia, provides separate chapter regarding university administration and its dispute settlement mechanism. It is earnestly hoped that the present work will provide the required fillip.
About Author - Dr. A.K. Avasthi (b. 1950), B.Sc, LL.M., LL.D., is a Professor of Law in Lucknow University which has been his almajnater of higher education. Having topped at the LL.M. examination in 1975, he is the recepient of Chancellor's Bronze Medal as well. His field of specialization is Constitutional & Administrative Law ofUSA, UK & India. He has contributed several articles in different law journals besides participating and reading papers in various conferences and workshops on law, constitutional law and human rights.
The present work is pioneer in the field and a maiden attempt to dwell in detail on the position of Governor vis-avis Chancellor. The importance of the work may be gauged by the fact that it drew the attention of the UGC luminaries to include it in the syllabus of LL.B. (Hons) course.
